GENERAL TERMS <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">1.1. The seller i.e. owner of the Kavial webshop (hereinafter referred to as online store) is KAVIAL O\u00dc (registry code 10060472), located at J. Smuuli tee 42 \/ Vesse 3, 11415, Tallinn, Estonia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1.2. These Terms of sale apply to purchases of goods from the online store, but also\nby phone, fax or by enquiry form located at seller's website.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1.3. The sales agreement enters into force when the amount payable is transferred to the\nbank account of the online store owner.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. ORDER PLACEMENT AND PAYMENTS <\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">2.1. Order processing deadlines<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">2.1.1. Orders are processed every workday from 8:30 till 17:00. In case if order was\nplaced at the end ofthe day, at weekend or state holiday, order confirmations,\ninvoices, price offers or other documents and e-mails confirming the processing\nofthe order will be sent only on the next (nearest) working day.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2.2. Order placement and payments in webshop <\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">2.2.1. The prices ofthe products sold in the online store are indicated next to the products. A fee for shipping is added to the price. All prices are in euros (\u20ac).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2.2. Webshop order minimum amount is 10 euros.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2.3. To activate discounts and display customer prices, the customer must contact KAVIAL O\u00dc customer service. The discounts stipulated in the contract are activated after checking the data and setting up the customer's webshop account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2.4. A fee for shipping is added to the price. The shipping cost depends on the\nlocation ofthe purchaser and the shipping method. The shipping cost is\ndisplayed when the purchaser places the order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2.5. Product information is provided immediately adjacent to the product in the online store or in catalogues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2.6. To place an order the desired products need to be placed into online store shopping cart. Required fields must be filled and suitable shipping method must be selected. The total cost is then displayed on the screen and can be paid securely via the following payment methods:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Revolut<\/li>\n\n\n\n<li>Latvian bank payments: Swedbank, SEB, Luminor, Citadele, Revolut<\/li>\n\n\n\n<li>Lithuanian bank payments: Swedbank, SEB, Luminor, Citadele, \u0160iauli\u0173 bankas, Urbo, Revolut<\/li>\n\n\n\n<li>Mastercard \/ Visa card payments<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">NB! After making the payment, wait until the payment portal redirects you back to the webshop<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2.7. Payments are mediated by Swedbank AS in cooperation with EveryPay payment portal. Payment is made outside webshop in a secure environment. The seller does not have access to the customer's bank and credit card data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2.8. KAVIAL O\u00dc is responsible for personal data processing. KAVIAL O\u00dc transmits necessary personal data to the authorized payment processor Swedbank AS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.2.9. If seller cannot deliver the ordered goods due to stock running out or for any\nother reason, the purchaser will be informed as soon as possible and the money\npaid (including the shipping cost) will be refunded promptly, but no later than\nwithin 14 days of receiving the notification.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2.3. Order placement and payments by prepayment invoice<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">2.3.1. The buyer has the opportunity to place an order by making an enquiry via telephone, fax, e-mail, webshop or the enquiry form located on the seller's website and pay for the goods by prepayment invoice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.3.2. After order confirmation, the seller will forward prepayment invoice to the buyer's e-mail. The buyer pays for the goods within specified period, indicating\nthe invoice or webshop order number in the payment details field.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.3.3. If buyer fail to pay for the order within payment terms, the seller has the right to\ncancelthe order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.3.4. In case of delay in payment, the seller has the right to demand from the buyer\nlate payment interest 0.1% (zero point one percent) on the sum unpaid by the\nprescribed term for each delayed day.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2.4. Order placement and payments in physical store<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">2.4.1. The buyer has the opportunity to pickup goods and pay on the spot, in store, Kavial office. The person must be either\nthe actual buyer or the buyer's authorized representative, confirming the purchase \/ pickup right with ID or letter of attorney (POA).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.4.2. In KAVIAL O\u00dc office it is possible to pay in cash or by Visa \/ Mastercard card.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. RECIEVING OF GOODS AND CARRIER SERVICE<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">3.1. The goods will be dispatched \/ handed over to courier only after receipt of\npayment is confirmed by the seller, unless the parties have arranged otherwise\nin advance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.2. The purchaser bears the shipping cost and the respective price information is\ndisplayed next to the shipping method.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.3. The goods are delivered to Estonia and European Union countries. Webshop orders are available for delivery within Estonia, Latvia, Lithuania and Finland only. Worlwide delivery is by agreement only.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.4. All shipments within Estonia generally arrive at the destination specified by the purchaser within 1-3 business days of the date of entry into force of the contract of sale. All shipments outside of Estonia are guaranteed to arrive within calendar 1-14 days. Seller have the right to ship goods in up to 45 calendar days in exceptional cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.5. If ordered item's delivery time increases significantly, the buyer will be notified as soon as possible, and in this case the buyer has the right to cancel the order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3.6. KAVIAL O\u00dc's delivery partner is DPD Eesti AS. KAVIAL O\u00dc transmits necessary personal data to the authorized delivery processor DPD Eesti AS.<\/p>\n\n\n\n<p class=\"has-text-align-left wp-block-paragraph\">3.7. Max package dimensions for parcel lockers:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Height 37cm<\/li>\n\n\n\n<li>Width 40cm<\/li>\n\n\n\n<li>Depth 60cm<\/li>\n\n\n\n<li>Weight up to 20kg<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">3.8. Max package dimensions for courier:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Package longest side not exceeding 175cm<\/li>\n\n\n\n<li>Single box max weight up to 31,5kg<\/li>\n\n\n\n<li>Single halfpallet weight up to 239kg<\/li>\n\n\n\n<li>Single pallet weight up to 700kg<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">3.9. Orders are dispatched every workday from 16:00 to 17:00.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. RIGHT OF WITHDRAWAL <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">4.1. After receiving the order, the purchaser has the right to withdraw from the\ncontract entered into with the e-store within 14 days. The right to withdraw from the contract does not apply ifthe buyer is a legal person (legal ground: Law\nof Obligations Act \u00a7 1 (5), \u00a7 56 (1)).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.2. To exercise the 14-day right of withdrawal, you must not use the ordered goods\nin any way other than is necessary to ensure the nature, characteristics, and\nfunctioning ofthe goods in the same way you would be allowed to test the\ngoods in an actual store.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.3. If the goods have been used for any purpose other than is necessary to ensure\nthe nature, characteristics, and functioning ofthe goods, or ifthere are any\nsigns of use or wear and tear, the online store has the right to lower the amount\nreturned in accordance with the decrease in the value ofthe goods.<\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">4.4. To return the goods, customer must submit a declaration of withdrawal (written\nin free form, but with indicated bank account number and order or prepayment\nnumber) to <a aria-label=\"info@kavial.ee (opens in a new tab)\" class=\"rank-math-link\" href=\"mailto:info@kavial.ee\" target=\"_blank\" rel=\"noreferrer noopener\">info@kavial.ee<\/a> or use a <a class=\"rank-math-link\" href=\"https:\/\/kavial.ee\/en\/refund\/\" target=\"_self\">refund claim form<\/a> on Kavial website. Declaration\nmust be applied within 14 days from the date of receipt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.5. The purchaser shall bear the cost of returning the goods, except in cases where\nthe reason for the return lies in the fact that a refundable product does not\ncomply with the order (e.g. a wrong or defective product).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.6. The purchaser must return the goods within 14 days ofthe submission ofthe\ndeclaration of withdrawal or submit evidence that they handed over the goods\nto the carrier within the aforementioned period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.7. Upon receiving the returned goods, the online store shall return to the\npurchaser, immediately but no later than after 14 days, all ofthe payments\nreceived from the purchaser based on the contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.8. The online store has the right to refuse to make a refund untilthe goods being\nreturned are received or untilthe buyer has provided proof of returning the\nproducts, whichever occurs first.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.9. If the buyer has clearly chosen a different form of shipment than the cheapest\nusual form of shipment offered by the online store, the store is not required to\ncompensate the cost exceeding the usual shipping cost.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.10. The online store has the right to withdraw from the sale and demand that the\ngoods be returned by the purchaser ifthe marked price ofthe goods in the online store is significantly lower than the market price ofthe goods due to an\nerror.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4.11. 14-day right of withdrawal does not apply to goods purchased locally at the KAVIAL O\u00dc store and to customers with contract. In this case, the parties must agree on the terms of withdrawal separately.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5. CLAIMS <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">5.1. The online store is responsible for the non-compliance of goods sold to a\npurchaser with the terms and conditions ofthe contract or for deficiencies\nwhich already existed at the time of delivery and which occur within two years\nof delivering the goods to the purchaser. Within the first six months of delivery,\nit is assumed that the defect was present at the time of delivery. It is the online\nstore's responsibility to prove otherwise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">5.2. The purchaser has the right to turn to the online store within two months ofthe\noccurrence of a defect by e-mailing <a href=\"mailto:info@kavial.ee\" target=\"_blank\" aria-label=\"info@kavial.ee (opens in a new tab)\" rel=\"noreferrer noopener\" class=\"rank-math-link\">info@kavial.ee<\/a> or calling <a href=\"tel:+3726205081\" target=\"_blank\" aria-label=\"+3726205081 (opens in a new tab)\" rel=\"noreferrer noopener\" class=\"rank-math-link\">+3726205081<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.3. The online store is not liable for any defects arising after delivering the goods to\nthe purchaser, including damages caused by inaccurate exploitation or not\nintended use ofthe goods.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.4. If goods bought from the online store have defects for which the online store is\nresponsible, the online store will repair or replace the defective goods. Ifthe\ngoods cannot be repaired or replaced, the online store shall return to the\npurchaser all ofthe payments involved in the contract of sale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5.5. The online store will respond to the consumer 's complaint in written form or in\na form that enables written reproduction within 15 days.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. PRIVACY POLICY <\/h2>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">6.1. Detailed information about personal data processing can be found on <a aria-label=\"siin (opens in a new tab)\" class=\"rank-math-link\" href=\"https:\/\/kavial.ee\/en\/privacy\/\" target=\"_blank\" rel=\"noreferrer noopener\">Kavial O\u00dc\u00a0privacy policy\u00a0page<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">7. IRRESISTIBLE FORCE (FORCE MAJEURE) <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">7.1. Non-fullfilment of obligations described in current Terms of sale shall not be\nconsidered as violation if caused by impediments which occurrence the parties\ndid not foresee or could not have foreseen (force majeure).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">7.2. According to current Terms of sale force majeure is considered as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>general strike, mass unrest<\/li>\n\n\n\n<li>war<\/li>\n\n\n\n<li>natural disaster<\/li>\n\n\n\n<li>act of authorities which significantly impedes obligations fullfilment<\/li>\n\n\n\n<li>other unlisted circumstances that both parties accept as force majeure <\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">7.3. The party whose activity is impeded due to force majeure circumstances shall\nimmediately notify the other party in written form.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">8. DISPUTE RESOLUTION <\/h2>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">8.1. All complaints made by a purchaser about the KAVIAL O\u00dc online store must be e-mailed to\n<a href=\"mailto:info@kavial.ee\" target=\"_blank\" aria-label=\" (opens in a new tab)\" rel=\"noreferrer noopener\" class=\"rank-math-link\">info@kavial.ee<\/a> or submitted by calling <a href=\"tel:+3726205081\" target=\"_blank\" aria-label=\" (opens in a new tab)\" rel=\"noreferrer noopener\" class=\"rank-math-link\">+3726205081<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">8.2. If the purchaser and the online store are not able to settle the dispute by\nagreement, the purchaser may contact the <a aria-label=\"siin (opens in a new tab)\" class=\"rank-math-link\" href=\"https:\/\/komisjon.ee\/et\/avalduse-esitamine\/\" target=\"_blank\" rel=\"noreferrer noopener\">Consumer Dispute Committee<\/a>. The\nConsumer Dispute Committee is competent to resolve disputes arising from a\ncontract between a purchaser and the online store. The resolution of disputes\nby the Consumer Dispute Committee is free of charge for the purchaser.<\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">8.3.
